Waivelo Business Terms of Service
Operator: JC&X SOLUTIONS LLC (Florida) | Contact: support@waivelo.com
1. Agreement and eligibility
These Waivelo Business Terms ("Terms") govern use of the Waivelo software service by a business customer ("Customer"). Waivelo is operated by JC&X SOLUTIONS LLC ("Waivelo," "we," or "us"), a Florida limited liability company. The service is offered for businesses based in the United States. An individual accepting these Terms for a business represents that they have authority to bind that business. Before authorizing a paid subscription, an authorized business account owner must affirmatively agree to these Terms through Waivelo’s subscription-consent flow before proceeding to Stripe Checkout. Waivelo records the accepting account, server timestamp, and exact policy versions and content hashes separately from waiver-participant consent.
Waiver participants do not become subscribers merely by signing a Customer’s waiver. The content of a Customer’s waiver and any consent to electronic signatures are separate from the Customer’s agreement with Waivelo.
2. What Waivelo provides
Waivelo provides tools for businesses to create and publish waiver forms; collect participant information, consent indications, and signatures; maintain signed records and PDFs; and administer related check-in, visits, waitlists, locations, and staff access. Waivelo is a technology provider, not a law firm, insurance provider, identity-verification service, or guarantor of waiver enforceability.
Customer determines the activity, waiver text, required notices and disclosures, permitted signers, and information it collects. Customer is responsible for assessing applicable laws and obtaining professional advice about its forms and activities.
3. Accounts and business responsibilities
Customer must provide accurate business and account information, use the service lawfully, maintain authorized staff access and secure account credentials, and promptly notify us at support@waivelo.com of suspected unauthorized access. Customer is responsible for actions taken through its authorized user accounts, except as prohibited by law.
Customer must not interfere with the service, evade security controls, submit malicious code, access another business’s records without authority, or use the service to violate others’ rights. Customer must not collect unnecessary sensitive participant information and must determine whether additional contractual or regulatory protections are needed for its particular use.
4. Customer content and electronic records
Customer retains its rights in waiver text, participant submissions, and other content it provides or directs us to collect ("Customer Content"). Customer grants Waivelo the limited permission needed to host, process, reproduce, display, transmit, secure, and retain Customer Content for delivery and operation of the service and as otherwise described in the Privacy Notice and these Terms.
Waivelo records the data submitted in the signing process, including signature-stroke information and timestamps, and produces associated signed documents. Customer is responsible for determining when electronic signatures and records may legally be used and for any required notices, consent, copy delivery, recordkeeping, or other legal obligations. Waivelo does not independently verify a signer’s identity or the legal validity of a waiver.
5. Optional parent or legal guardian signing
Customer may enable a feature allowing an adult to declare that they are a parent or legal guardian signing for one minor participant. The minor is identified as the participant, and the adult is identified as the signer. The feature records the adult’s declared relationship, authority attestation, signature, and signing information. Waivelo does not independently verify parentage, custody, age, legal authority, or whether a waiver signed for a minor is enforceable.
Customer must determine whether its activities and the applicable law permit guardian execution of a waiver, supply required waiver language and notices, and follow applicable requirements concerning children’s personal information. Enabling this feature is not a compliance certification.
6. Free trial and paid subscription
A qualifying new business organization receives a 30-day trial without entering a payment card. The trial does not automatically convert to a paid subscription, and trial expiration alone does not authorize or trigger a charge. At trial expiration, new operational activity is restricted unless the organization has qualifying paid access or another approved access entitlement.
The standard subscription is $29.99 USD per organization per month, plus applicable taxes. A business must affirmatively authorize the recurring subscription through the displayed Waivelo consent flow and Stripe Checkout. Before authorization, the business is shown the recurring price, applicable billing timing and taxes, and cancellation/refund terms. Once authorized, charges and renewals follow the billing schedule disclosed during Checkout. Payment card details are handled by Stripe, not by Waivelo’s application.
Waivelo may change pricing for future billing periods only with appropriate advance disclosure and any consent required by law. Taxes are applied only where legally applicable and correctly configured.
7. Cancellation, failed payment, and refunds
Customer may cancel its subscription through the available self-service billing portal. Cancellation is effective at the end of the already-paid billing period, with new recurring renewals stopped accordingly. No automatic prorated refund is offered for unused time in that period, except where required by law.
Erroneous or duplicate charges will be refunded. Other refund requests are considered individually, subject to applicable law. If a qualifying recurring payment fails, the organization has a seven-day operational grace period measured from the first applicable failed renewal; repeated failures do not extend the period. If payment remains unresolved after that period, new operational activity is restricted. A trial that expires without a paid subscription does not receive this failed-renewal grace period.
8. Historical records, access, and closure
When operational access is restricted due to billing, authorized users may continue to access existing signed waivers, PDFs, and historical records, subject to normal authentication, authorization, retention, and applicable law. Waivelo will not automatically delete legally significant signed records solely because a subscription expires or is canceled. Reactivated qualifying subscriptions restore normal operational access after verified payment status.
Requests concerning business account closure, available data exports, or deletion can be sent to support@waivelo.com. We will verify the requester’s authority and review each request against technical feasibility, legal obligations, preservation of signed evidence, and the approved retention practices. Closing an account or canceling a subscription does not itself erase signed records, audit history, provider-held information, logs, or backups. No fixed deletion deadline or guaranteed complete erasure is promised here.
9. Security, providers, and service availability
The service uses authentication, organization-scoped authorization and private storage controls, but no internet service is risk-free. We use service providers to host and operate Waivelo, including the providers identified in the Privacy Notice. Waivelo may maintain, update, or temporarily restrict the service for security, technical, or legal reasons. No uptime percentage, restoration time, or support response-time service-level commitment is offered under these standard Terms.
10. Suspension and termination
We may restrict or suspend access when reasonably needed to address security threats, misuse, unlawful activity, nonpayment, or material breaches, consistent with applicable law. Where appropriate and feasible, we will provide notice and an opportunity to resolve the issue. Any termination and handling of stored records remain subject to the preservation and applicable-law principles above.
11. Warranties, liability, and third-party claims
To the extent permitted by law, the service is provided on an “as available” basis without a promise that a Customer’s waiver is enforceable, that a signer has legal authority, or that the service will be uninterrupted or error-free. Mandatory legal rights are not excluded.
12. Changes and contact
Version: 1.0. Effective date: 2026-10-20. Material changes will be communicated as required by law, and renewed acceptance or consent will be obtained when legally required. Questions, notices, and account requests may be sent to support@waivelo.com.
